1. Use of the Website

You agree to use our website, www.chickadeescateringandbakery.com, and services only for lawful purposes and in accordance with these Terms. You may not:

• Use the website in any unlawful or fraudulent manner

• Engage in any activity that disrupts, damages, or impairs the functionality of the website

• Attempt to gain unauthorized access to our website or its systems

• Use the website to transmit viruses, spam, or other malicious content

2. Catering Services

Our website allows you to browse, inquire about, and place orders for catering services. All catering orders are subject to availability and confirmation by CHICKADEE'S LLC.

We reserve the right to:

• Refuse or cancel orders at any time for any reason, including but not limited to pricing errors, supply issues, or concerns about the delivery location.

• Modify menu items, prices, and services at our discretion and without prior notice.

• Substitute items based on availability, with reasonable notice to the customer.

3. Booking and Payment

To book catering services, you must place your order with 6 months notice. Upon confirming your order, the following applies:

• A 25% may be required to secure the order.

• Full payment must be made 30 days after the event or at the time of delivery, unless otherwise agreed.

• We accept payments via Check made out to CHICKADEE'S LLC, Venmo, or Cash at this time.

By placing an order, you agree to pay the full amount due for the service, including applicable taxes, delivery charges, and any additional fees.

4. Cancellations and Refunds

Cancellations:

• If you cancel a scheduled service order 4 months or more in advance, you will receive a full refund (unless any non-refundable charges such as deposits or fees).

• If you cancel an order within 2 months of the scheduled service, you may not receive a refund, or a partial refund will be provided, depending on incurred costs.

• Cancellations made within 2 weeks of the event date are non-refundable, as ingredients and preparations are typically already underway.

Refund Process:

• Approved refunds will be processed within 5–10 business days via the original method of payment.

• Please note that bank or credit card processing times may vary.

5. Allergies and Dietary Requirements

We make reasonable efforts to accommodate dietary restrictions and allergies, but CHICKADEE'S LLC cannot guarantee that our food is free from allergens, such as nuts, dairy, gluten, or other substances. Customers are responsible for communicating their dietary needs and restrictions in advance, and we will do our best to accommodate them.

6. Delivery and Setup

• Delivery: We will make reasonable efforts to deliver catering orders at the agreed-upon time and location. However, CHICKADEE'S LLC is not responsible for delays caused by factors beyond our control (e.g., traffic, weather, accidents).

• Setup: If setup is included in the service, we will provide it at the agreed-upon location, but any additional requests or modifications may be subject to additional fees.

• Delivery Charges: Delivery fees may apply depending on the location of the event.

7. Intellectual Property

All content on our website, including logos, trademarks, text, images, and other media, are the property of CHICKADEE'S LLC and are protected by U.S. copyright and intellectual property laws. You may not use, reproduce, distribute, or display any part of the website without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, CHICKADEE'S LLC will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, including but not limited to loss of profits, data, or business opportunities.

For catering orders, our liability is limited to the amount paid by the customer for the service in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless CHICKADEE'S LLC, its officers, employees, and agents from and against any and all claims, damages, liabilities, or expenses (including attorney’s fees) arising out of or related to your use of the website, your catering order, or any breach of these Terms and Conditions.

10. Privacy Policy

Our Privacy Policy describes how we collect, use, and protect your personal information when you use our website and services. By using the website, you agree to the practices outlined in our Privacy Policy.

11. Dispute Resolution

Any disputes arising from or related to these Terms and Conditions will be governed by the laws of the State of Missouri. All disputes must be resolved through binding arbitration, rather than in court, except that you may seek injunctive or other equitable relief in a court of competent jurisdiction.

Arbitration will be conducted under the rules of the American Arbitration Association (AAA), and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

CHICKADEE'S LLC reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be posted on this page, and the updated version will take effect immediately upon posting.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles.
